General Terms & Conditions for the Dropshipping Entrepreneur

Article 1 – Definitions

In these general terms and conditions, the following definitions apply:

Withdrawal Period: The period during which the consumer may exercise their right of withdrawal;

Consumer: A natural person who is not acting in the exercise of a profession or business and who concludes a distance contract with the entrepreneur;

Continuous Performance Contract: A distance contract relating to a series of products or services, where the obligations are spread over time;

Right of Withdrawal: The possibility for the consumer to withdraw from the distance contract during the withdrawal period;

Entrepreneur: The natural or legal person offering products or services remotely to consumers;

Distance Contract: A contract concluded between the entrepreneur and the consumer through remote communication techniques;

CESOP: The Central Electronic System of Payment Information introduced by the EU to monitor payment service providers.

Article 3 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded.

Before the agreement is concluded, the text of these general terms and conditions will be made available to the consumer electronically or by another appropriate method.


Article 4 – The Offer

Offers are non-binding. The entrepreneur reserves the right to modify offers.

The offer clearly specifies the total costs, including shipping costs, customs duties, and additional fees.


Article 5 – The Agreement

The agreement is concluded once the consumer accepts the offer and complies with the stated conditions.

The entrepreneur will confirm acceptance of the order by email without delay.


Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the agreement within 30 days after receiving the product, without providing any reason.

To exercise this right, the consumer must inform the entrepreneur in writing during the withdrawal period.

The consumer may use the European standard withdrawal form, but this is not mandatory.

The consumer bears the direct return shipping costs.


Article 7 – Costs in Case of Withdrawal

The entrepreneur will refund all payments received within 30 days after notification.

The refund will be made using the same payment method.

The entrepreneur may delay the refund until the products have been received or proof of return has been provided.

Products must be returned in their original condition and packaging.


Article 8 – Customs, Import Duties & Sales Tax Responsibility

8.1

All goods are shipped under Delivered Duty Unpaid (DDU) terms in accordance with Incoterms® 2000.

The customer is solely and fully responsible for all import-related costs and obligations.

8.2

These obligations include:

(a) the payment of import duties, sales tax, GST, and other taxes;

(b) customs clearance, brokerage, inspection, or handling fees;

(c) compliance with local laws, regulations, and certifications.

8.3

The entrepreneur is not the importer of record.

Responsibility and ownership transfer to the customer at the time of shipment.

The entrepreneur is not responsible for delays, seizures, or penalties related to customs obligations.

8.4

The entrepreneur provides commercial documentation but does not guarantee compliance with local requirements.

The customer is solely responsible for verifying import regulations.

8.5

The customer agrees to indemnify the entrepreneur against any financial consequences or penalties resulting from non-compliance with regulations.

8.6

Customers are strongly advised to consult local customs authorities before placing an order.


Article 9 – CESOP Compliance

From 2024 onward, payment data will be recorded in the CESOP system in accordance with EU regulations.

The entrepreneur fully complies with these regulations.


Article 10 – Compliance and Warranty

Products comply with the agreement and applicable legal standards.

Complaints must be submitted within 14 days.

Products must be returned in their original condition.


Article 11 – Delivery

Orders are delivered within 30 days unless otherwise agreed.

Orders are shipped under conditions that make the customer responsible for import procedures.

Import-related issues do not entitle the customer to a refund or cancellation.


Article 12 – Complaint Resolution

Complaints must be submitted within 7 days.

A response will be provided within 14 days.

If additional time is required, the consumer will be informed.


Article 13 – Disputes

These terms and conditions are governed by Belgian law.

Disputes will be resolved amicably or submitted to the courts of West Flanders, Belgium.


Article 14 – Order Processing & Estimated Delivery Times

Orders are processed within 3 business days.

Orders are delivered within 30 days unless otherwise agreed.

Delivery times are indicative and non-binding.

The entrepreneur accepts no liability for delays caused by external factors, including but not limited to customs processing, carrier delays, weather conditions, or logistical disruptions involving UPS, USPS, FedEx, DHL Express, or other shipping providers.

Delays do not entitle the customer to compensation or refunds.


Article 15 – Address Accuracy & Delivery Responsibility

The customer is fully responsible for providing accurate shipping information.

Address modifications may be possible within 24 hours.

An order marked as delivered by UPS, USPS, FedEx, DHL Express, or another shipping carrier shall be considered fulfilled.

Risk transfers to the customer upon delivery.

The entrepreneur accepts no responsibility for lost or stolen packages after delivery confirmation.


Article 16 – Returns & International Logistics

The right of withdrawal remains fully applicable.

Returns are at the customer’s expense and risk.

Returns may be sent to an international warehouse.

The entrepreneur accepts no responsibility for returns lost in transit or held by customs authorities.


Article 17 – Order Cancellation & Automated Fulfillment

Orders are processed automatically and immediately.

Cancellation is only possible within 24 hours after purchase.

After this period, cancellation is no longer possible.

The customer must await delivery and use the right of withdrawal if desired.


Article 18 – Limitation of Liability

Liability is limited to direct damages and the amount of the order.

The entrepreneur shall not be liable for indirect damages.

The entrepreneur shall not be liable for customs or regulatory issues.


Article 19 – Acceptance of Policies

By placing an order, the customer confirms having read and accepted:

  • the General Terms & Conditions

  • the Shipping & Delivery Policy

  • the Returns & Refund Policy

  • all other policies published on the website

All policies form an integral part of the agreement.

Placing an order constitutes explicit consent to all conditions, including those related to customs, importation, delivery, and returns.
